Guardianship Records in Manatee County

Guardianship cases involve a court-appointed adult acting for a person who cannot act for themselves. Adult guardianship can address daily affairs, property, or both, depending on the order. Minor guardianship places an adult in charge of a child outside the parent-child relationship. The Twelfth Circuit's Probate Division also handles competency findings and involuntary hospitalization under Florida's Baker Act.

Guardianship files often contain medical reports, psychological evaluations, guardian plans, financial accountings, and minor identifying information. The Clerk's confidential icon examples specifically include psychological evaluations and reports of guardianship. Many guardianship images are restricted online to protect the ward's privacy.

Estate Administration in Manatee County

Probate of a decedent's estate starts with a petition filed in the Circuit Court Probate Division. The Clerk records the petition, the will if there is one, and the order appointing a personal representative. Notice goes to heirs, beneficiaries, and creditors. The personal representative inventories the assets, pays valid creditor claims, and distributes the remaining property.

Florida uses three types of administration: summary administration for small estates, formal administration for larger or more complex estates, and disposition without administration for very limited assets. Each one has its own filing rules. The court enters a final order discharging the personal representative when the work is done.

Note: Florida law sets time limits for creditor claims and elections, so consult counsel early if you are a personal representative or beneficiary.

Confidential Probate Documents

Not every probate document is public online. The Clerk's online searches page says probate documents may not be available as ordinary public online images. The Clerk uses two icons in the docket. A lock icon means the document is viewable on request after manual review. A confidential icon means the document is sealed.

  • Psychological evaluations - confidential under Fla. Stat. § 394.4615.
  • Guardianship plans and reports - protected from public online view.
  • Minor identifying information - redacted under Rule 2.425.
  • Death certificates - confidential in many forms; the Clerk records some but vital-record certified copies come from the Florida Department of Health.
